Rental conditions for the rental of holiday homes at EhuseRENTAL TERMS 2023, Ehuse
1. Definitions Holiday home A holiday home is a property that is not used for year-round residence and is rented out by the owner(s) through Ehuse ApS (hereinafter referred to as "Ehuse"). Holiday home owner The natural or legal person who has access to the holiday home and who has given Ehuse the right to rent out the holiday home through a brokerage agreement. Holiday home renter / tenant The legal or natural person over 18 years of age who rents the holiday home from the holiday home owner through Ehuse. Agreement basis The documents signed by Ehuse and the tenant (together referred to as "the Parties") in connection with the rental of the holiday home, as well as these rental terms. Rental period The period during which the tenant has access to the holiday home, as specified in the rental agreement. Arrival day The first day of the rental period. Departure day The last day of the rental period. Holiday home information The information provided under the specific holiday home on Ehuse's website. Days Calendar days, including Sundays and public holidays.
Ehuse makes the holiday home available to a tenant on behalf of the holiday home owner.
The rental period begins on the day specified in the agreement basis. The agreement basis provides information to the tenant about the facts of the holiday home, key delivery, and when on the arrival day the tenant can expect to be able to use the holiday home. Key delivery must be done upon presentation of valid photo identification. The rental property must be vacated no later than 10:00 am on the departure day.
Use of the Holiday Home The holiday home may be used for holiday purposes during the rental period. If Ehuse suspects that the holiday home is not being used for holiday purposes, Ehuse is entitled to gain access to the holiday home. If the suspicion is confirmed, this will be considered a breach of the agreement basis. Refer to section 15. Guests The tenant is allowed to invite guests to the holiday home. However, the holiday home must not be occupied by more people than stated in the holiday home information. If the holiday home is occupied by more people than permitted, this will be considered a breach of the agreement basis. Refer to section 15. Pets Pets are only allowed if specified in the holiday home information. Internet The tenant can assume that there is Wi-Fi in the holiday home unless otherwise stated in the holiday home information. Ehuse does not guarantee coverage or quality of the Wi-Fi installed in the holiday home. Smoking Smoking is only allowed if specified in the holiday home information. Swimming Pools, etc. The tenant is obliged to follow the instructions provided at all times regarding the safety and use of swimming pools and similar facilities in the holiday home. Ehuse accepts no responsibility for the functioning or safety of the swimming pool. The tenant is aware of and accepts that the use of swimming pools and similar facilities is at their own risk.
The prices stated are the rental prices for one (1) week and are specified in Danish Kroner (DKK) and inclusive of VAT. Taxes are included in the prices. The rental fee does not include consumption unless otherwise specified. This will be settled separately after the end of the rental period. Booking made more than 60 days before the start of the rental period The tenant can split the payment into installments, with the first installment due at the time of booking and the second installment due no later than 30 days before the start of the rental period. Booking made less than 60 days before the start of the rental period The total rent is due at the time of booking.
6. Cancellation and Modification of Reservation The tenant is entitled to cancel a reservation under the following conditions Cancellation made more than 40 days before the start of the rental period The tenant will be refunded the total price for the holiday home during the rental period, minus a 25% administration fee. Cancellation made less than 40 days before the start of the rental period The tenant is not entitled to a refund of the total price for the holiday home during the rental period. Modification If the tenant wishes to modify a reservation, the tenant is entitled to do so for an administration fee of DKK 750.00. If the modification results in a shortening of the rental period by a minimum of 7 days, the tenant is entitled to a refund for the changed period under the same conditions as if the tenant had canceled that period, as mentioned above. If the modification results in a shortening of the rental period by less than 7 days, the tenant is not entitled to a refund.
7. Consumption If consumption is not included in the price of the holiday home, it has to be paid by the end of the stay. At the Arrival, a consumption form is provided for registering the consumption. On this form, the tenant is required to read the meter at the end of the rental period. Ehuse has done it before the arrival. Regarding electric cars, the tenant is only allowed to charge them at the holiday home if an approved charger is installed.
8. Deposit Ehuse is not charging the tenant a deposit. If damages has been made, Ehuse or the holiday home owner is entitled to claim compensation from the tenant according to the general principles of Danish law of torts. Refer to section 10.
9. Defects and Complaints Ehuse delivers the holiday home to the tenant at the start of the rental period without defects. If, contrary to expectations, there are defects in the holiday home or its furnishings, the tenant must report it to Ehuse by phone as soon as possible and no later than 48 hours after the start of the rental period. The tenant is obligated to limit the defect as much as possible during the rental period. If Ehuse requests to rectify the defect during the rental period, the tenant is obliged to cooperate in making this possible. If the matter is not resolved satisfactorily during the rental period, the tenant must submit a written complaint to Ehuse within 14 days, describing the details of the complaint, sent to post@ehuse.dk.
10. Damages During the Rental Period The tenant is obliged to treat the holiday home and its furnishings with care during the rental period. The tenant is responsible to the holiday home owner for any damages caused by the tenant, their household, or guests to the holiday home or its furnishings during the rental period. If the tenant is responsible for any damages, Ehuse will not cover it. The tenant is obliged to report damages to Ehuse no later than on the departure day. If Ehuse becomes aware of damages not reported by the tenant and not reported as defects, as mentioned in section 9, during the final cleaning or otherwise, Ehuse will make a claim for compensation from the tenant and also charge an administration fee of DKK 1,500.
11. Insurance The tenant acknowledges and accepts that Ehuse cannot be held liable for personal injury that may occur during the rental period. Ehuse has not taken out insurance covering personal or property damage for the tenant.
12. Tenant's Right to Complain As a holiday home agent, Ehuse is subject to the The tenant can submit any disputes that may arise with Ehuse to the above-mentioned complaints board if a mutual solution cannot be reached.
13. Final Cleaning At the end of the rental period, also if final cleaning has been orderet, the tenant must leave the holiday home with the dishwasher emptied, and the grill cleaned, etc. If the tenant fails to do so, Ehuse is also entitled to charge a fee of DKK 350 in this case.
14. Termination If the tenant breaches the terms and conditions of the agreement, Ehuse is entitled to terminate the agreement with the tenant, resulting in the tenant immediately vacating the holiday home. In such a case, the tenant will not be entitled to any refund for the remaining days of the rental period. Ehuse, on the other hand, is entitled to assert any claims for compensation against the tenant according to the general principles of Danish law of torts.
15. Choice of Law and Jurisdiction All disputes between Ehuse and the tenant will be settled in accordance with Danish law, with jurisdiction in the district where the holiday home is located.
16. Ehuse's Rights In the following cases, Ehuse reserves the right to either refund the paid rental amount or find alternative rental accommodations: Expedition errors Printing errors
17. Force Majeure and Extraordinary Events In the event that, due to circumstances that could not reasonably be foreseen by Ehuse at the time of entering into this agreement (force majeure), including but not limited to war, strike, natural disasters, pandemic, epidemic, pollution, or public restrictions, the holiday home cannot be made available without significant costs or difficulties, Ehuse has the right to terminate the rental agreement with immediate effect on its own behalf and on behalf of the owner. If Ehuse terminates the rental agreement due to force majeure, the tenant is not entitled to compensation, and Ehuse is entitled to recover all incurred expenses from the tenant, such as handling fees, as well as any costs arising from the termination of the rental agreement.
18. Personal Data Ehuse processes a range of personal data about the tenant. More information can be found in Ehuse's privacy and cookie policy. Deposit payment for consumption of electricity, heating, and waterWe do not take a deposit. When you hand over the keys at the end of your holiday, you pay the consumption costs. Before your arrival, we will turn on the electricity and in winter we will turn on the heating. This service is free of charge. We write the meter stands down and the consumption costs are charged from this point on. If you would like this to be different, please let us know at least one week before arrival.
